You asked:
3. Please send me copies of all Serious and Untoward Incident Review documents which relate to the treatment of mental health patients within your trust.
Our response:
Under Section 12 of the Freedom of Information Act 2000, public authorities are not obliged to comply with a request for information if the cost of compliance is estimated to exceed the “appropriate limit.” For NHS organisations, this limit is set at £450, which equates to 18 hours of staff time at a statutory rate of £25 per hour.
Following a preliminary assessment, we estimate that the time required to locate, retrieve, and extract the information you have requested would significantly exceed this limit. Therefore, we are not obliged to comply with your request on this occasion.
If you would like to refine or narrow the scope of your request, we would be happy to advise and assist you in doing so, which may help bring it within the cost limit.
Please let us know if you would like to proceed in this way.
