I sent a Freedom of Information request on 18 January 2022 regarding Disclosure and Barring Service DBS. checks. I would like to withdraw that request and submit the following request. I apologise for my error. This is a request for information under the Freedom of Information Act 2000. Please note there are eight parts to this request. 1. 2. 3. What is the current size of your workforce? Please include both staff and volunteers in this figure. 4. 2. 3. 4. Thank you for your recent Freedom of Information request. Please find our response below.

In the past ten years how many members of your workforce have committed sexual misconduct?
Of those, how many were referred to the DBS?”

The following information has been provided in terms of allegations relating to sexual misconduct upheld at a hearing or where the investigation report concluded there was evidence to support the allegation being considered at a hearing if the individual resigned before the hearing took place.

Sexual misconduct has been taken to mean: inappropriate and unwanted behaviours of a sexual nature, including all forms of sexual violence; sex without consent; sexual abuse; non-consensual sexual touching; unwanted behaviour of a sexual nature which violates dignity, makes someone feel intimidated, degraded or humiliated or creates a hostile or offensive environment; stalking; abusive or degrading remarks of a sexual nature.

On that basis in the last 10 years 18/02/2014-17/02/2023. the information we have available indicates a total of 7 staff.
Please note prior to the merger in 2019 we only hold information for 2gether NHS Foundation Trust.

HR records do not reflect whether those were referred to the DBS as that decision is held outside of our team, however a referral to the DBS would only be made at the end of the process if the police had not been made aware of the concerns earlier in the process.
